Consultation on the new Rules of the OIA Scheme.

A consultation on changes to the OIA Rules closed on 31 May 2015. The revised Rules reflect changes to comply with legal requirements arising from UK implementation of a new EU Directive on Alternate Dispute Resolution; the new Consumer Rights Act 2015; and an internal review of OIA processes.

The main substantive changes to the Rules are:

  • Amending the definition of HEIs to include new members
  • Bringing eligibility criteria into line with requirements of the EU ADR Directive
  • Extending the time limit for bringing a complaint from three months to 12 months. This is because the regulations which implement the ADR Directive state that the minimum timeframe must be one year from the date upon which the body complained about has given notice that the complaint cannot be resolved
  • Revising the review process to reflect the requirements of the EU ADR Directive and changes to be implemented following our internal process review. This includes a change to process followed once a Complaint Outcome has been issued.

The new Rules came into effect on 9 July 2015 (the date upon which the EU ADR Directive comes into force).
