Accommodation - CS012405

A student received a warning for violating the Student Code of Discipline because smoke in their room set off the fire alarm in their accommodation.

The student submitted a complaint to the provider. The student said that there was no evidence that they had been smoking in the room and that the fire alarm had been caused by candles in their room. The provider rejected the complaint because although there was a dispute about whether the smoke was caused by candles or cigarettes, neither was permitted under the student’s rental agreement.

The student complained to us. We did not uphold the complaint (we decided it was Not Justified). We decided the provider followed the correct procedure, that the decision was reasonable, and that a written warning was a proportionate sanction.
